1. Scope of Application

These Terms and Conditions apply to all contracts between Christin Elisabeth Lösch (hereinafter referred to as the "Provider") and clients (hereinafter referred to as the "Client") regarding the planning and execution of children's birthday parties, childcare, and related services.

2. Conclusion of Contract

A contract is formed upon written or verbal order confirmation by the Provider. The free initial consultation does not establish a contractual relationship.

3. Scope of Services

The specific scope of services (date, location, theme, duration, included services) is agreed upon individually and confirmed in writing. Changes to the scope of services require the written consent of both parties.

4. Prices and Payment

Prices are offered individually and agreed upon in writing. The invoice is due within 14 days of invoicing unless otherwise agreed. For bookings with short notice (less than 14 days before the event), full payment in advance is due.

5. Cancellation by the Client

• Cancellation more than 30 days before the event: no cancellation fee. • Cancellation 14–30 days before the event: 50% of the agreed price. • Cancellation less than 14 days before the event: 100% of the agreed price. Costs already incurred for materials or special orders will be charged in any case.

6. Cancellation by the Provider

In case of unforeseen absence (e.g., illness), an alternative date will be offered or the amount already paid will be fully refunded. Further claims are excluded.

7. Obligations of the Client

The Client ensures that: • The event location is accessible and suitable in good time. • All relevant information (allergies, special needs of the children) is communicated in advance. • An adult supervisor appointed by the Client is present throughout the entire event.

8. Supervisory Duty

The Provider assumes entertainment and supervision of the children within the framework of the agreed program. Legal supervisory duty always remains with the legal guardians or their appointed representatives.

9. Liability

The Provider is liable for damages only in cases of gross negligence or intent. Liability for slight negligence as well as for indirect damages and lost profits is excluded to the extent permitted by law.

10. Photos and Data Protection

Photos or videos taken during the event may only be published with the express consent of the legal guardians of the children depicted. The Provider will always ask for separate permission before any publication of impressions.

11. Applicable Law and Jurisdiction

Austrian law applies. For consumers, the law of their country of residence applies additionally, to the extent that it is mandatory. The place of jurisdiction is, as far as legally permissible, the registered office of the Provider.

12. Dispute Resolution

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. The Provider is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
